US Congress – Acts & Laws

The two branches of the United States Congress, the U.S. Senate and the U.S. House of Representatives, periodically pass laws that can directly or indirectly affect programs, projects and program/project management (P/PM) in the United States.  This section of the library provides access to some of them.  We will add more in the future.

Program Management Improvement and Accountability Act (2016) – United States Senate bill S.1550, approved on 30 November 2016, reforms federal program management policy in the United States to enhance accountability and best practices in project and program management throughout the federal government. Improving the Management of Federal Programs and Projects through Implementing the Program Management Improvement Accountability Act (PMIAA) – June 2018 Memorandum for Heads of Executive Departments and Agencies from Mick Mulvaney, Director, Office of Management and Budget, U.S. Government. GPRA Modernization Act of 2010
- Legislation updating the 18-year-old Government Performance and Results Act (GPRA). The original 1993 law required agencies to create multi-year strategic plans, annual performance plans, and annual performance reports. The new legislation made some significant changes to existing law and was expected to take several years to implement. The new legislation created a more defined performance framework by prescribing a governance structure and by better connecting plans, programs, and performance information. As described in the Senate committee report, the new law requires more frequent reporting and reviews for federal agencies that were intended to increase the use of performance information in program decision-making. Project Management Oversight: Final Rule (49 CFR Part 633)
(1989) – This law passed by the US congress in 1989 implemented section 324 of the Transportation and Uniform Relocation Assistance Act of 1987.  This section permitted the Urban Mass Transportation Administration (now the Federal Transit Authority within the US Department of Transportation) to use up to ½ of 1 percent of the funds made available in each fiscal year under UMTA’s capital grants programs for project management oversight of capital projects.  Section 324 also required a recipient implementing a major capital project with Federal financial assistance from UMTA to prepare and implement a project management plan.
